This privacy statement indicates how your personal data is processed when using the Liebr app (the App) and the website https://Liebr.be (the Website). This processing takes place under the responsibility of Liebr NV with registered office at Beversesteenweg 576, 8800 Roeselare, Belgium and registered in the CBE under number 0809.928.917.

Please read this Privacy Policy carefully as it contains your rights and obligations towards Liebr NV. 

This Privacy & Cookie Policy may be regularly revised or updated and we advise you to review it regularly. 

Article 1 – General 

1.1. Liebr strives to comply with the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, which transposes, supplements and implements European Regulation 2016/679 of 27 April 2016 on the protection of personal data, as well as the anti-spam provisions of Book XII of the Code of Economic Law regarding the ‘law of the electronic economy’ (where applicable).

1.2. By means of the current Privacy Policy, LiebrNV also complies with European Regulation 2016/679 of 27 April 2016 on the protection of personal data. 

1.3. The party responsible for the processing of your personal data is Liebr NV. A statement has been made to the Commission for the Protection of Privacy regarding the processing of your personal data. 

Article 2 – Personal data that you communicate to us 

2.1. during a visit to this Website:

  • IP address;
  • profile name, password, e-mail address, login details and (possibly profile image) when registering on our Website;

2.2. when subscribing to our newsletter:

Article 3- Personal data that we collect indirectly 

3.1. Public data of the client, customer or other business relationship 

Liebr NV sometimes processes public data, e.g. data that is subject to a publication obligation, such as the publication of your appointment as director of a company, or data that you have made public yourself, such as information on your website, or data that are generally known published in your region or in the press, or data on e.g. the Crossroads Bank for Enterprises and Graydon. 

Article 4 – Purposes of processing 

4.1. General Purposes: 

Liebr NV will only use the collected personal data for the following purposes:

IP address (see article 2.1): for the maintenance and improvement of this Website and the inclusion of Personal Data in anonymous statistics, from which the identity of specific persons or companies cannot be traced, with the legitimate interests of Liebr NV as legal basis for its to continuously improve the website and services;
profile name, password, e-mail address, login details and (possibly profile image) (see article 2.1) when registering on our Website : for the purpose of managing your account on this Website, to be able to provide you with the requested information or services and to to comply with legal requirements. With as legal basis the execution of an agreement requested by you, and, if indicated by you, also the sending of direct marketing, with as legal basis your explicit, prior consent; 
e-mail address (when subscribing to the newsletter) (see article 2.2.): with a view to sending you direct marketing (automatic e-mail messages or other electronic messages), newsletters, employment information, or information about planned activities (lectures, seminars, working lunches) with your explicit, prior consent as a legal basis; 
name, address, e-mail address, telephone number, payroll information, curriculum vitae, motivation letters, notes made during the job interview, information about education and work experience, evaluation forms and results of any tests and assessments, payroll information including national register number, address, seniority, marital status, bank account number , family composition, date of birth, wages and payslips (see Articles 2.3 and 2.4): to be able to provide you with the requested services and to comply with the legal requirements with the legal basis of the execution of an agreement. 
photos and videos (see article 2.3 and 2.4.): to use for our internal communication with your explicit, prior consent as the legal basis; 
name, e-mail address, telephone number, bank account number (see Article 2.5): in order to provide you with the requested services and to comply with legal requirements with the legal basis for the execution of an agreement requested by you, and, if indicated by you, also sending direct marketing, with your explicit, prior consent as the legal basis. 

Chat session content: In order to avoid abuse (both social law/tax law and competition) on our app as much as possible, Liebr can scan the content of the chat box by means of automatic word recognition and take appropriate measures where necessary. The information from a chat session will under no circumstances be used for commercial purposes by Liebr NV. The legal basis is your explicit prior consent. 

You are not obliged to disclose your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing. 

4.2. direct marketing: 

The personal data will also be used for direct marketing, provided you have given additional explicit permission for this. 

If you are already included in our mailing list for receiving marketing material in electronic form, Liebr NV can use your data to send marketing related to Liebr NV, its services. 

In addition, Liebr NV can also pass on your data to its partners, with a view to direct marketing.

4.3. Transfer to third parties: 

Liebr NV can share your personal data with:

  • Liebr affiliates within the House of HR group.
  • Potential clients where we want to realize a match between you and the client or where you work for us.
  • Processors and/or recipients who provide services or carry out assignments on behalf of Liebr NV. This could include, for example, suppliers (IT providers, social secretariat, market research agency, meal voucher providers, etc.). These parties only have access to the data they need to fulfill their contractual obligation.
  • In some cases, you may be required to share personal data based on a court order or court order.
  • Pension fund, government agencies and other agencies (such as consultancy) if we believe we are obliged or entitled to do so.

In any case, the personal data mentioned will be kept in accordance with the specific legal regulations, as well as the limitation periods that oblige us to keep your personal data longer, e.g. to defend us against a legal claim. 

Article 6 – Your rights

6.1. Right of access and inspection: 

You have the right to inspect your personal data free of charge at any time, as well as the use that Liebr NV makes of your personal data. 

6.2. Right of improvement, deletion and restriction: 

You are free to decide whether or not to communicate your personal data to Liebr NV. In addition, you always have the right to request us to correct, supplement or delete your personal data. You acknowledge that in case of refusal of communication or request to delete personal data, certain services and products are not available. 

You may also request that the processing of your personal data be restricted. 

6.3. Right of opposition: 

You also have a right to object to the processing of your personal data for serious and legitimate reasons. 

In addition, you always have the right to object to the use of personal data for direct marketing purposes; in such a case you do not have to give any reasons. 

6.4. Right of free data transfer:

The processing of Your Personal Data does not include profiling and you will not be subject to automated decisions by us.

This is without prejudice to a remedy before a civil court. 

If you would suffer damage as a result of the processing of your personal data, you can file a claim for compensation. 

Article 7 – Security and Confidentiality

7.1. We have developed security measures adapted at technical and organizational level to avoid the destruction, loss, falsification, alteration, unauthorized access or inadvertent notification to third parties of personal data collected, as well as any other unauthorized processing of this information. 

7.2. Under no circumstances can Liebr NV therefore be held liable for any direct or indirect damage resulting from incorrect or unlawful use of the personal data by a third party. Liebr NV have ensured that when they call on third parties for the processing of personal data, these third parties will be bound by the same rules. 

7.3. You must comply with the security regulations at all times, including by preventing any unauthorized access to your login and code. You are therefore solely responsible for the use made from the Website of your computer, IP address and of Your identification data, as well as for their confidentiality.

8.1. In order to process your personal data, we grant access to your personal data to our employees. 

8.2. We guarantee a similar level of protection by making contractual obligations enforceable against these employees and appointees, which are similar to this Privacy Policy.

Article 11 – Applicable law and competent court 

This Privacy Policy is governed, interpreted and executed in accordance with Belgian law, which is exclusively applicable. 

The courts of Kortrijk have exclusive jurisdiction to hear any dispute that may arise from the interpretation or implementation of this Privacy Policy. 

In case of contradiction between the English and French Privacy & Cookie Policy with the Dutch version, the Dutch version will take precedence.
